By October 19, 1781, the British formally surrendered finally ending the Revolutionary War and acknowledging the US as victors in this prolonged, deadly battle for freedom from the Crown. However, it was not until the Treaty of Paris was signed on September 3, 1783, that the US was officially acknowledged as the victor in this fight (click to enlarge the treaty document).

In the lawsuit Oregon v. Trump docket # 25-6268 appeal of 3:25-cv-01756 (discussed in my October 1, 2025 and October 9, 2025 ANP articles) filed in the 9th Circuit Court of Appeals on October 5, 2025, a stay was granted on October 20, 2025.Judges Nelson & Bade concur, Judge Graber dissents to the order of stay citing:
The President’s authority to federalize the National Guard is statutory, not constitutional. Newsom, 141 F.4th at 1046. The Constitution vests the power to call forth the militia in the legislative branch. U.S. Const. art. I, § 8, cl. 15. Under that enumeration, Congress has enacted several statutes, including § 12406, which delegate the calling forth power to the President.
Therefore, Judges Nelson & Bade grant the motion for a stay pending appeal. This allows the Trump Administration to Federally activate Oregon's National Guard to protect ICE agents & ICE facilities from domestic terrorists.
