Presidential Actions & Articles, Lawfare, OBBB Title VIII Continued, Patriot John Penn, And More

On July 24, 2025, the White House released the Briefing StatementH.R. 4 and H.R. 517 Signed into Law S. 1582in actuality he signed 3 congressional bills into law:

1. H.R. 4, the Rescissions Act of 2025, which rescinds certain budget authority proposed to be rescinded in special messages transmitted to the Congress by the President on June 3, 2025, in accordance with section 1012(a) of the Congressional Budget and Impoundment Control Act of 1974; discussed in my July 18, 2025 ANP Article.

2. H.R. 517, the Filing Relief for Natural Disasters Act, (click here for the pdf of this law) which amends the Internal Revenue Code of 1986, effective July 24, 2025, to modify the rules for postponing certain deadlines by reason of disaster. This act amends IRS Code of 1986 to extend federal tax deadlines by 120 days IF a written request of the Governor of a State is made to the Secretary (after consultation with the Administrator of FEMA) for a "qualified" state declared disaster. Qualified disasters are listed as:

. . .with respect to any State, any natural catastrophe (including any hurricane, tornado, storm, high water, wind-driven water, tidal wave, tsunami, earthquake, volcanic eruption, landslide, mudslide, snowstorm, or drought), or, regardless of cause, any fire, flood, or explosion, in any part of the State, which in the determination of the Governor of such State (or the Mayor, in the case of the District of Columbia) causes damage of sufficient severity and magnitude to warrant the application of the rules of this section. . . .For the purposes of this section "State" includes the Mayor of the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.

3. S. 1596, the Jocelyn Nungaray National Wildlife Refuge Act, (click here for the pdf of this law) which renames the Anahuac National Wildlife Refuge located in the State of Texas as the Jocelyn Nungaray National Wildlife Refuge. This law finds:

1. On June 17, 2024, 12-year-old Jocelyn Nungaray was brutally murdered in Houston, Texas.

2. Two illegal aliens who were allegedly members of the Tren de Aragua gang have been charged with her murder.

3. On March 4, 2025, President Donald J. Trump signed Executive Order 14229 (90 Fed. Reg. 11585; relating to honoring Jocelyn Nungaray)(and accompanying Fact Sheet) renaming the area known as the Anahuac National Wildlife Refuge to ``Jocelyn Nungaray National Wildlife Refuge'' wherein it specifies:

Section 1: The prior administration's immigration policies inexcusably endangered and caused enormous suffering within our Nation, including by causing the southern border to be overrun by cartels, criminal gangs, known terrorists, human traffickers, smugglers, unvetted military-age males from foreign adversaries, and illicit narcotics. These open-border policies are responsible for the horrific and inexcusable murders of many innocent American citizens at the hands of illegal aliens. One of those innocent victims was Jocelyn Nungaray, whose life was tragically cut short on June 17, 2024, when she was brutally murdered in Houston, Texas. Two Venezuelan illegal aliens who were allegedly Tren de Aragua gang members and were apprehended near the border in early 2024and then released into the United States by the prior administrationhave been charged with her murder. Jocelyn was a precious 12 year old girl beloved by her family and friends for her kindness and infectious zeal for life. She loved animals and had a passion for ensuring that they had homes. It is fitting and in the national interest, therefore, that the Anahuac National Wildlife Refuge, a scenic area for coastal wildlife and recreation along the Gulf of America near Jocelyn's home in Texas, will forever honor and preserve the memory of a beautiful American, Jocelyn Nungaray.

Section 2:Within 30 days of the date of this order, pursuant to authority under the National Wildlife Refuge System Administration Act (16 U.S.C. 668dd-668ee) and other applicable law, the Secretary of the Interior (Secretary) shall update procedures as necessary and take all other appropriate actions to rename the area known as the Anahuac National Wildlife Refuge as the Jocelyn Nungaray National Wildlife Refuge and ensure that her life is permanently commemorated therein. The Secretary shall subsequently provide guidance to ensure all Federal references to the Jocelyn Nungaray National Wildlife Refuge, including on agency maps, contracts, and other documents and communications, reflect its renaming.

4. Ms. Nungaray loved animals and, given the close proximity of her hometown of Houston, it is fitting that the Anahuac National Wildlife Refuge be renamed in her honor.

I find it interesting that Congress can pass single-subject legislation for things like renaming a National Wildlife Refuge but NOT for things WE THE PEOPLE WANT signed like English as our National Language, Election Integrity, and stopping "birthright" Citizenship (for foreign people who simply give birth on US soil). Congress needs to MAGA their priorities!

On July 24, 2025, the White House published the Fact Sheet:President Donald J. Trump Secures Major Settlement with Columbia University(I have not seen a Presidential Action on this so far) addressing Federal Civil Rights violations based on Columbia University's actions. Columbia was found to be engaged in unlawful racial discrimination in hiring, admissions, or university programming. They were fined $200,000,000 of which over $20,000,000 will go to Jewish employees. The agreement also addresses privacy, dignity, and fairness in women's sports, programming, facilities, and housing. The agreement mandates a comprehensive review of Columbia's programs to remove discriminatory programs. Columbia must now prohibit masking during approved protests and their security must be trained by NYPD. The Office of the Provost will now monitor student discipline and rules. Since this agreement reinstated most of the terminated federal grants, I would say Columbia agreed to get the money back. The actions of Columbia University have spurred the DOE to look for similar issues at other colleges and universities (such as Pennsylvania where the University there has agreed to keep men out of women's sports and restore trophies and records of the women who actually won in the women's competition).

Which brings us to the July 24, 2025 EOSaving College Sports signed July 24, 2025 protecting student-athletes and collegiate athletic scholarships and opportunities, especially in women's programs. The EO also provides for legal protection for athletes who are unreasonably challenged under antitrust or other legal theories. It also provides for protection of the US Olympic and Paralympic teams. The accompanying Fact Sheetfurther explains the EO prohibits 3rd party, pay-for-play payments to collegiate athletes (does not apply to legitimate fair-market-value compensation for things such as brand endorsements). It tasks the AG & FTC to protect student-athletes' rights and safeguard them from endless debilitating antitrust and other legal challenges. The President recognizes the importance of college sports and its "critical role in fostering leadership, education, community pride, the need to address urgent threats to its future." President Trump has a long-standing commitment to "showcasing American greatness through sports" as he pushes to secure women's sports for women, securing bids to host world-renown sports competitions in the US, attending sporting events from wrestling matches to collegiate sporting events, and hosting numerous victorious sporting teams at the White House.

The 3rd EO that President Trump signed July 24, 2025 isEnding Crime and Disorder on Americas Streetsto address endemic vagrancy, disorderly behavior, sudden confrontations, and violent attacks that are making our cities unsafe. The accompanying Fact Sheet: President Donald J. Trump Takes Action to End Crime and Disorder on Americas Streetsfurther explains the EO is designed to end vagrancy and restore order thereby ensuring Americans feel safe in their own cities and towns. The AG is directed to reverse judicial precedents and end consent decrees that limit State and local government ability to commit individuals on the streets who are a risk to themselves or others. It orders the AG to work with Secretaries of HHS, HUD, and Transportation to prioritize grants to those states and municipalities that enforce prohibitions on open illicit drug use, urban camping, loitering, urban squatting, and who track the locations of sex offenders. The order ensures states and municipalities do not fund drug injection sites or condone illicit drug use. The order also prohibits sex offenders receiving homelessness assistance from being house in places where there are children and also allows for programs to exclusively house women and children. Promises Made/Promises Kept: the President is committed to making America safe again while ending homelessness:

In 2023 President Trump saidWe will use every tool, lever, and authority to get the homeless off our streets. We want to take care of them, but they have to be off our streets.

In March 2025, President Trump signed EO 14252 Making the District of Columbia Safe and Beautiful directing the National Park Service to clear all homeless encampments and graffiti on Federal lands.

In May 2025, President Trump signed an Executive Order establishing the National Center for Warrior Independence, a place where homeless veterans can go to receive the care, benefits, and services to which they are entitled discussed in my May 10, 2025 ANP Article.

As part of First Lady Melania Trumps BE BEST Initiative, the Department of Housing and Urban Development announced a $1.8 million dollar investment to prevent homelessness among young Americans aging out of the foster care system also discussed in myMay 10, 2025 ANP Article.

Finally, on July 24, 2025 the White House published 2 articles:

These companies are being set up to make billions of dollars, why wouldn't they be in favor of it? For the rest of us, it spells DOOM. Massive databases of your spending habits, reading habits, internet surfing habits, social media comments, etc. How can this lead to anything except massive restrictions on the average US Citizen? Perhaps not in the beginning, but let the wrong people 'get into power' and we will see how effectively these same tools can be wielded against the average person.


On July 24, 2025 President Trump visited the Federal Reserve Building re-construction. He let Jerome Powell know he is well versed in construction sites and cited $3.1 billion as the cost of the reconstruction and Powell denied it. President Trump then reached into his pocket and pulled out a piece of paper from one of Powell's employees and handed it to Powell. The overruns on this project are enormous! I suspect there will be an investigation into whether or not fraud or waste are involved in this 'project.'


Now, when will he visit Fort Knox to see if our country's gold is truly there? He said he was going there back in February 2025 but nothing has been reported about it to date.

Today's installment of "What's in the OBBB" continues with OBBB Title VIII Committee on Health, Education, Labor, and Pensions, sections 83001 to 83004 (page 278 to 282).

Subtitle D Pell Grants

Sec. 83001. Eligibility. (a) Foreign Income and Federal Pell Grant Eligibility (1) Adjusted Gross Income Defined will now include foreign income of the student's parents for a dependent student or the student's foreign income (and that of the student's spouse's foreign income) beginning on or after July 1, 2026. And a new section (f) Ineligibility of Students With a High Student Aid Index - Notwithstanding subparagraphs (A) through (E), a student shall not be eligible for a Federal Pell Grant under this subsection for an academic year in which the student has a student aid index that equals or exceeds twice the amount of the total maximum Federal Pell Grant for such academic year. Effective on July 1, 2026.

Sec. 83002. The effective date of this section shall take effect on July 1, 2026 and shall apply beginning with award year 2026-2027. Workforce Pell Grants adds:

(a) In General - Section 401 of the Higher Education Act of 1965 (20 USC 1070a) is amended:

(k) Workforce Pell Grant Program - (1) In General - for the award year beginning on July 1, 2026, and each subsequent award year, the Secretary shall award grants (to be known as 'Workforce Pell Grants') to eligible students under paragraph (2) in accordance with this subsection.

(2) Eligible Students - To be eligible to receive a Workforce Pell Grant under this subsection for any period of enrollment, a student shall meet the eligibility requirements for a Federal Pell Grant under this section, except that the student - (A) shall be enrolled, or accepted for enrollment, in an eligible program under section 481(b)(3) (hereinafter referred to as an 'eligible workforce program'); and (B) may not - (i) be enrolled, or accepted for enrollment, in a program of study that leads to a graduate credential; or (ii) have attained such a credential.

(3) Terms and Conditions of Awards - The Secretary shall award Workforce Pell Grants under this subsection in the same manner and with the same terms and conditions as the Secretary awards Federal Pell Grants under this section, except that - (A) each use of the term 'eligible program' (except in subsection (b)(9)(A)) shall be substituted by 'eligible workforce program under section 481(B)(3); (B) the provisions of subsection (d)(2) shall not be applicable to eligible workforce programs; and (C) a student who is eligible for a grant equal to less than the amount of the minimum Federal Pell Grant because the eligible workforce program in which the student is enrolled or accepted for enrollment is less than an academic year (in hours of instruction or weeks of duration) may still be eligible for a Workforce Pell Grant in an amount that is prorated based on the length of the program.

(4) Prevention of Double Benefits - No eligible student described in paragraph (2) may concurrently receive a grant under both this subsection and - (A) subsection (b); or (B) subsection (c).

(5) Duration Limit - Any period of study covered by a workforce Pell Grant awarded under this subsection shall be included in determining a student's duration limit under subsection (d)(5).

(b) Program Eligibility for Workforce Pell Grants - Section 481(b) of the Higher Education Act of 1965 (20 USC 1088(b)) is amended by adding:

(3)(A) A program is an eligible program for purposes of the Workforce Pell Grant program under section 401(k) only if - (i) it is a program of at least 150 clock hours of instruction, but less than 600 clock hours of instruction, or an equivalent number of credit hours, offered by an eligible institution during a minimum of 8 weeks, but less than 15 weeks; (ii) it is not offered as a correspondence course, as defined in 600.2 of title 34, Code of Federal Regulations (as in effect on July 1, 2021); (iii) the Governor of a State, after consultation with the State board, determines that the program - (I) provides an education aligned with the requirements of high-skill, high-wage (as identified by the State pursuant to section 122 of the Carl D. Perkins Career and Technical Education Act (20 USC 2342)), or in-demand industry sectors or occupations; (II) meets the hiring requirements of potential employers in the sectors or occupations described in subclause (I); (III) either - (aa) leads to a recognized postsecondary credential that is stackable and portable across more than one employer; or (bb) with respect to students enrolled in the program - (AA) prepares such students for employment in a occupation for which there is only one recognized postsecondary credential; and (BB) provides such students with such a credential upon completion of such program; and (IV) prepares students to pursue 1 or more certificate or degree programs at 1 or more institutions of higher education (which may include the eligible institution providing the program).

This section reads to me like it complies with EO 14277 Advancing Artificial Intelligence Education for American Youth discussed in my April 25, 2025 ANP Articleadding something akin to a work apprenticeship Pell Grant.

Sec. 83003. Pell shortfall strikes $2,170,000,000 and inserts $12,670,000,000.

Looks to me like they expect a lot of businesses to set up Workforce Pell Grant Eligible Programs.

Sec. 83004. Federal Pell Grant exclusion relating to other grant aid adds (6) Exclusion - Beginning on July 1, 2026, and notwithstanding this subsection or subsection (b), a student shall not be eligible for a Federal Pell Grant under subsection (b) during any period for which the student receives grant aid from non-Federal sources, including States, institutions of higher education, or private sources, in an amount that equals or exceeds the student's cost of attendance for such period.

Seems to me this section stops the 'double dipping' some students manage to accomplish to the detriment of other students who are seeking limited aid programs.

And sometimes, that's enough to help shape a nation.

Today's Patriot is John Penn who was born May 17, 1741 near Port Royal in Caroline County, Virginia. John was an only child. Because his father did not believe in education, he was only allowed to attend the common school for 2 years. When his father died in 1759 when John was 18, his mother discovered that education was absolutely necessary, so she arranged for Jon to privately meet with his uncle to 'read law' wherein he became a lawyer in Virginia in 1762. It is said he literally lived in his uncle's library which was described as having "no equal in the colonies" filled with history, biography, religion, and philosophy.

John married Susannah Lyne on July 28, 1763 and they had 2 children. In 1774, the family moved to Stovall (near Williamsboro), North Carolina where John was a representative at the colony's Third Provincial Congress in August 1775.

John was not a fan of the Stamp Act and was very outspoken with his thoughts. He was charged in 1774 with "saying disrespectful things" about the act (and possibly the Crown), was found guilty, but only charged a penny as a fine because the judge probably sympathized with him. John refused the pay the penny. I wondered if this is where the phrase "a penny for your thoughts" comes from - it isn't, it is attributed to Sir Thomas More in 1522.

John was elected to the Continental Congress in 1775, 1777, 1778, and 1779. He signed both the Declaration of Independence, Articles of Confederation, and the Halifax Resolves (the North Carolina Constitution). Over this 5 years, John received only an occasional travel voucher (it took about 2 weeks to travel from his home to Independence Hall).

On August 23, 1780, John served on a 3-man Board of War in North Carolina. John quickly discovered the other 2 were incompetent. He was in communication with General Greene (who replaced Gates), and helped to raise recruits, find funding, provide transportation, provide supplies, disarmed Tories, and spurred people into action for the war effort. In 1781 North Carolina Governor Burke recalled John and abolished the Board of War, most likely due to John's success.

By 1780, John retired from public life and returned to lawyering. His health was declining. He was tapped as "Receiver of Taxes" in 1784 and served for 4 years.

John died September 14, 1788, he was 47 years old, and most likely died of poor health. He was buried a few miles northeast of Stovall in Granville County, North Carolina. In 1894, his remains were interred under the Signers Monument along with remains of William Hooper at the Guilford Courthouse National Military Park.

The USS John Penn (APA-23), an attack transport of WWII and the only ship in her class, was named in his honor. The first ever historical highway marker in North Carolina honored John and was erected near is home in Stovall in 1936.
